The Health Information Technology for Economic and Clinical Health (HITECH) Act, was put forth as part of the American Recovery and Reinvestment Act of 2009, and subsequently signed into law on February 17, 2009. The aim of the HITECH Act is to essentially promote the adoption and meaningful use of health information technology. Additionally, Subtitle D of the HITECH Act addresses the well-known HIPAA privacy and security concerns associated with the electronic transmission of protected health information via numerous provisions that effectively strengthen the civil and criminal enforcement of the Health Insurance Portability and Accountability Act (HIPAA) rules. What’s interesting to note is that even though HIPAA was signed into law in 1996, enforcement has been extremely fractured and disjointed, but the passing of the HITECH ACT, along with the Final Omnibus Rulings of January, 2013 has now given HIPAA tremendous enforcement powers. Additionally, HITECH also puts forth provisions for the Department of Health and Human Services (HHS) to perform periodic audits of Covered Entities (CE) and Business Associates (BA) regarding compliance with the HIPAA Privacy, Security, and Breach Notification Rules. In 2011, HHS OCR formerly established the HIPAA pilot audit program, and it’s now in full force, which means Covered Entities (CE) and Business Associates (BA) need to put in place all mandated HIPAA specific information security and operational policies, procedures, and related processes for compliance.
